Stephen Koslow and Patrick Graber Obtain Dismissal

Stephen D. Koslow and Patrick M. Graber of McCullough, Campbell & Lane LLP obtained a Federal Rule 12(b)(2) dismissal in favor of Cessna Aircraft Company, Textron Aviation, Cessna Service Direct LLC d/b/a Mesa Citation Service based on the lack of personal jurisdiction in the U.S. Northern District Court of Illinois.

In a 14-page opinion dated January 18, 2017, District Judge Manish S. Shah held that Plaintiffs My Canary LLC and Chicago Aviation, Inc. failed to make a prima facie showing that any of the Cessna defendants had sufficient minimum contacts with Illinois for general or specific jurisdiction. Plaintiffs’ complaint alleged breach of contract, breach of implied covenant, and fraud against Mesa, and tortious interference and conspiracy against all of the Cessna defendants relating to the pre-buy survey and sale of a Cessna 510 Mustang aircraft.
